Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of Sairaph Mail (the "Service"), operated by WELLDONE (Aleja Wyzwolenia 11/6, 70-552 Szczecin, Poland; NIP PL8531508847). It forms part of, and is incorporated into, our Terms of Service (the "Terms"). Capitalised terms not defined here have the meaning given in the Terms. This AUP corresponds to Section 7 of the Terms and expands on it; if there is any conflict, the Terms govern.
Sairaph Mail is an email-sending and receiving service. Because outbound email directly affects the deliverability, reputation, and legal exposure of our platform, our upstream providers (in particular Amazon SES and OVHcloud), and other customers, we enforce this AUP strictly. You are responsible for all activity under your Account, including the activity of any automated agent acting on your behalf.

1. Your responsibility for what you send
1.1 You are solely responsible for the lawfulness, content, targeting, and consent status of every email you send through the Service, and for the deliverability and sending reputation of your domains and mailboxes.
1.2 You represent and warrant that you have all rights and lawful bases necessary for your Content and your sending, including the consent of recipients where required by law.

2. No spam / unsolicited commercial email
2.1 You must not use the Service to send unsolicited bulk or commercial email ("spam" / UCE), or any sending that breaches applicable anti-spam, e-privacy, or marketing law, including:
- the EU ePrivacy rules and GDPR consent and transparency requirements for direct marketing;
- the Polish *Ustawa o świadczeniu usług drogą elektroniczną* (electronic-services act) and *Prawo telekomunikacyjne* rules on unsolicited commercial communication;
- where relevant to recipients in the United States, the CAN-SPAM Act (including its requirements for accurate header and "From" information, non-deceptive subject lines, a clear identification of the message as an advertisement where applicable, a valid physical postal address, and a functioning opt-out honoured promptly); and
- any equivalent law applicable to your recipients.
2.2 In particular you must not:
- send marketing or commercial email without a valid lawful basis (e.g. consent, or another basis permitted for your recipients and jurisdiction);
- conduct high-volume cold outreach that lacks a lawful basis or required consent;
- send to purchased, scraped, rented, or harvested address lists;
- omit, falsify, or obscure required sender identification, opt-out mechanisms, or a valid reply path;
- fail to honour unsubscribe/opt-out requests promptly and on an ongoing basis;
- continue sending to recipients who have hard-bounced or complained (see Section 6).

3. Prohibited content and conduct
3.1 You must not use the Service to send, transmit, store, or facilitate:
- phishing, spoofing, social engineering, business-email-compromise, or fraud of any kind;
- malware, ransomware, spyware, or other malicious code, or links to it;
- illegal content, or content that infringes third-party intellectual-property or privacy rights;
- harassment, threats, defamation, or hateful content, or content inciting violence;
- content that violates export controls or sanctions, or that promotes illegal goods or services;
- child sexual abuse material (CSAM) — we operate a zero-tolerance policy; we will suspend the Account immediately, preserve evidence as required, and report to the competent authorities as required by law;
- any activity that violates ICANN/registry policies or the acceptable-use policies of OVHcloud or Amazon SES;
- attempts to circumvent quotas, suppression lists, rate limits, or security controls, or to gain unauthorised access to any system, account, or data.

4. Volume, rate, and infrastructure-abuse limits
4.1 You must not exceed the sending allowances, fair-use limits, and overage terms of your plan (see the Terms, Section 4), and you must not attempt to evade them (for example, by splitting traffic across mailboxes or accounts to avoid limits).
4.2 You must not engage in conduct that degrades, overloads, or threatens the integrity, security, performance, or reputation of the Service, our upstream providers, or other customers — including unthrottled mass sending, rapid mailbox/domain churn to evade reputation controls, or automated abuse of the API/MCP.

5. Automated sending-health controls
5.1 To protect the platform, our upstream providers, and other customers, Sairaph Mail monitors bounce and complaint rates on your mailboxes and applies automated controls:
(a) where a mailbox's sustained bounce/complaint rate exceeds 3%, we may automatically throttle that mailbox's outbound sending; and
(b) where it exceeds 5%, we may automatically disable outbound delivery for that mailbox until deliverability is restored.
5.2 These controls limit or pause outbound sending only. They do not remove your access to the Account, dashboard, or stored/cached mail, and inbound mail continues to flow. Restoring deliverability is your responsibility.

6. Suppression lists
6.1 The Service automatically suppresses recipients who hard-bounce or complain. You must not attempt to bypass or defeat suppression in a manner that breaches this AUP, and you must not re-send to suppressed addresses without a fresh, lawful basis.

7. Monitoring, enforcement, and suspension
7.1 We do not routinely monitor the content of your email. However, we reserve the right, at our discretion, to suspend or terminate sending, a mailbox, or your Account, and/or to remove or disable Content, where we reasonably believe it is necessary to: (a) address illegal use; (b) address a violation of the Terms or this AUP; (c) comply with applicable law or a lawful request; (d) comply with the acceptable-use policies of upstream providers, including Amazon SES and OVHcloud; or (e) protect the security, integrity, or reputation of the platform or other customers.
7.2 Where practicable and lawful, we will give notice and an opportunity to cure before suspension; in urgent cases (e.g. active abuse, CSAM, security risk, or upstream-provider demand) we may act immediately and without prior notice.
7.3 No refund on abuse. Where your Account is suspended or terminated for breach of this AUP, no refund is due for any unused period (Terms, Section 5.6), without prejudice to mandatory consumer rights that cannot be waived.

8. Reporting abuse
8.1 To report suspected abuse of the Service (spam, phishing, malware, CSAM, or other violations), contact abuse@sairaph.com. We investigate reports and take appropriate action, which may include the measures in Section 7.

9. Changes to this AUP
9.1 We may update this AUP from time to time. For material changes, we will notify you by email or in-product notice, consistent with the change process in the Terms. Continued use after the effective date constitutes acceptance.
